UFCW 175 (Mississauga)is currently challenging Molson Canada Inc. (Etobicoke) in Molson's right to accommodate one of its employee who is a UFCW member. In this instance, it's the union that does not support the actions of the company as well as the desire of one of its own members.
Past Supreme Court cases (Ontario human rights commission vs. Etobicoke) has ruled that Human Rights codes supercede any Collective Agreement.
Please note the rarity of such a case where the company has accommodated the employee in lines with past cases but the union is challenging this.
